Land Access & Future Acts
The Gingirana native title claim is registered with the National Native Title Tribunal. Therefore, any access on to the native title claim is regulated by the future acts process in the Native Title Act.
Access to Gingirana native title claim for mining or petroleum tenure purposes
Exploration and prospecting mineral titles
The Gingirana native title claimants have developed a standard Exploration and Prospecting Agreement with the purpose of protecting cultural heritage sites and areas of cultural significance during the conduct of exploration or prospecting activities within their native title claim area.
Central Desert encourages applicants for exploration and prospecting titles to accept the Exploration and Prospecting Agreement in its standard form to expedite the grant of the title. However, it can be utilised as the basis of negotiations between explorers and the Gingirana claimants. Negotiations in relation to the Exploration and Prospecting Agreement are conducted by Central Desert under instructions from the Gingirana claimants. Explorers may be invited to meet with the Gingirana claimants and negotiate any outstanding issues directly.
The Exploration and Prospecting Agreement updates, and supersedes, the old Ngaanyatjarra Council Regional Heritage Agreement. Regional Heritage Agreements are no longer accepted for the purpose of the conduct of exploration or prospecting activities within the Gingirana claim.
Other mineral and petroleum titles
Instructions will be required from the Gingirana claimants in relation to agreements for all other mineral and petroleum title applications on a case-by-case basis.
Access to Gingirana native title claim for non-mining and petroleum tenure purposes
All non-mining/petroleum titles on registered native title claims require an application to be made to the relevant government department and the requisite notifications to be made under the future acts process in Native Title Act.
