Central Desert can assist PBCs to fulfill their rights and responsibilities to their members and common law holders and meet their legislative requirements.

This includes compliance with:

  • the Corporation Rule Book;
  • the Corporations (Aboriginal and Torres Strait Islander) Regulations 2017 (CATSI Regulations);
  • the Native Title (Prescribed Bodies Corporate) Regulations 1999 (PBC Regulations); and
  • the Native Title Act 1993.

Other obligations include employment, taxation, superannuation, insurances, financial reporting.

When PBCs are ready, Central Desert works side by side with clients to transition corporate governance and financial management duties to PBC staff.

How does it work?

Upon engagement by a PBC, Central Desert allocates a PBC Support Officer (PBCSO) to the PBC. This Support Officer predominately provides Corporate Governance and Compliance Services to the PBC.

Some of these services might include:

  • Acting as the designated contact person as defined in the CATSI Act;
  • Coordinating statutory reporting, including the preparation of financial reports, annual audit and annual report;
  • Manages the PBC support funding application;
  • Maintains corporate records (including meeting minutes and member registers) in a confidential and secure way, providing access to Directors as needed;
  • Provides general secretarial support, including liaising with the Chair to arrange and conduct meetings;
  • Manages the PBC support funding application;
  • Administers governance activities in accordance with the PBC Rule Book

All information stored by Central Desert on behalf of the PBC remains the property of the PBC.
